Rate Relief in Tort-Reform States Essay Any act that is illegal, and not criminal, which may also be called a civil crime is a Tort. The attempt to, change court cases so as to avoid false verdicts that run into thousands of dollars is called Tort reform. A vehicle accident is one of the common types of tort; legal suits regarding malpractices in the medical fields are also torts. Tort reforms usually include awarding a limited amount of money for any type of damages like accidents, pain, distress and mental agony. For example in a car accident, the damage done to the car is $ 4,000 and the amount you need for medical treatment is 4,000. You have a total of $ 8,000 as economic damages. If you receive like say $ 5,000 for the pain and agony you have to undergo, it would come under non-economic damages. According to studies non-economic caps resulted in reduction in losses for general and medical malpractice cover, a decreased premium and greater profit for insurers, for medical malpractice legal responsibility  Ã‚   insurers. Which further resulted in a greater decline in the number of cases filed. On the other hand, physicians all over the country were looking for extra tort reform from the state officials in the 2005 legislative meeting. The stability of the insurance premium towards medical liability is the main goal of the physicians. In Connecticut physicians were looking for a cap on non-economic damages and a relief in insurance premium. In South Carolina, doctors pressed for a cap of $250,000 on non-economic damages and asked for removal of the ban against compulsory negotiations among patients and doctor. Texas is one of the crisis states among the19 states according to the American Medical Association, in which doctors are resigning, restraining high-risk procedures and retiring early on because they cant find or afford the money for insurance. The passage   of Proposition 12, which restricted non-economic damages in liability awards and payments at $250,000 per physician. After the passing of Proposition 12, which guaranteed the introduction of caps accepted previously by the Texas legislature, some physicians in Texas already reported genuine premium savings. Neal Sklaver, FACP, who was a general internist with Medical Specialists Associated in Dallas, is incredibly satisfied that his premium payments have plummeted roughly $5,000 since the Proposition 12 was passed in September 2003. According to some physicians the Proposition 12 helped the doctors, but they can be still be sued for anything. Until all liability carriers bring down their rates, the advantages of Proposition 12 might continue to elude some doctors, particularly those who are not specialized where previous rates were very high. What seems to be more disturbing is that, even doctors whose payments have reduced said that they have got used to practicing protective medicine, after so many years of working in a malpractice setting. Whatever the outcome, but the tort reform is a very important measure by the Government, which should be handled carefully. One in fifty operations might go wrong by a doctor. The Escalation of Piracy    Copyright laws were created in the late 1700s to protect authors from having their work reproduced without their consent. These laws have been in effect ever since in most parts of the world and have done little changing to keep up with the times. Piracy is the unauthorized use or reproduction of copyrighted or patented material. Piracy has been an issue for many years, but is gaining more and more press recently because it is getting out of control. Everything from books to video games are being pirated and it is costing their respective industries billions of dollars. There are varying degrees of piracy, and can be considered anything form downloading an artist’s song form KaZaA or mass distributing illegal copies of expensive business software.I will first discuss the casual pirate. This can be defined as anyone who violates copyright laws and steals intellectual property for their own use. This includes downloading music, movies, or software, or burning copies of these. The second form of piracy is the pirate that distributes this material for a profit. These pirates will buy or steal a copy of a program, and sell it on the internet for a fraction of the actual selling cost. The thing with digital reproduction is that a copy is exactly the same as the original, no quality loss. On top of that it costs the pirate nothing to produce, max 40 cents. That way he can sell the pirated software for whatever he wants. A 6000 dollar program can sell for anywhere between 100-500 dollars. The latter of the two of these forms of pirates have historically been the target the industries and government have been trying to stop. But recently most of the press has been going to the causal pirate. Peer to peer networks and the increasing popularity of faster broadband connections have led to a dramatic increase in illegal downloads. Anyone with an internet connection has instant access to music, movies, software, even video games to download for free. The most popular of these downloads however is by far music downloads. According to a February 2004 article form Wired Magazine’s website on a Monday morning at 10:00 there were about 3.1 million people sharing on KaZaA. And that is not peak time. This number far surpasses Napster’s numbers in its hay day. The fact is that peer to peer sharing is here to stay and there is vary little the RIAA can do to stop it.

Just War Essay

The just wars fought by the United States government against Indian tribes were iniquitous and questionable. The formulation of the concept of just and lawful war was proof of the same reason why most Indian tribes sided with England, that the Americans were corrupt and fraudulent. I believe that there is always a democratic and diplomatic way of handling problems and conflicts, especially when dealing with political and social issues. For instance, the U. S. government, holding a prominent and powerful place in society, should have exercised authority responsibly by surveying and gathering information regarding the concerns and demands of the tribes. There should have been in depth discussions regarding the peace-keeping process of local tribes, as well as its relation to their culture. When we talk about culture in the global context, we are talking about variety and difference. What I mean is that, there is and will never be one right culture. Cultural relativism, and the likes, proves such assertion. To apply this concept in the situation, what the U. S. government believes as a process of long term peace, may not be true to the beliefs and traditions of the tribes. Tribal conflicts have been a part of their existence, and long before the intervention of the Europeans and the Americans, they have managed to coexist despite conflicts, which they settle within their own means of setting up a common ground and bringing back social order. Therefore, the U. S. government should not have made assumptions about the practices of the tribes. Moreover, every person has the right to believe in things they want to believe in. So if tribes believe that the Americans are oppressive and chose to side with the English, then that is their own right – to look after their best interests in order to survive. They should not have been punished due to their beliefs and their prevailing instincts to survive and live in more desirable conditions. After the war ended, and the English were defeated, the U. S. government should have sat down with tribal leaders and talked about what things should be done in order to calm and satisfy the tribes. The just and lawful wars, as claimed by the U. S. government were tactless and unreasonable.
